What is Trademark Renewal?

A trademark registration in India is valid for 10 years and can be renewed indefinitely. Renewal should be done within six months before the expiry date. If missed, a reminder is sent to the registered address before expiry.

If no renewal application is filed, the Registrar may announce the intention to remove the trademark in the Trade Marks Journal—usually within a year after expiry.

Even after expiry, renewal is possible within six to twelve months by paying a restoration fee.

Restoring a Trademark

If the renewal deadline is missed, you can apply for restoration. Under Section 25(4) of the Trademark Act, 1999, restoration is permitted by filing the required application and paying the prescribed fee.

Steps Involved in Trademark Renewal in India
  1. Trademark Search: Check for identical or similar marks on the Indian Trademark Office website to avoid conflicts.
  2. Filing Renewal Application: Apply for renewal six months before or after expiry with an additional fee. Submission can be done online or at the Trademark Office.
  3. Application Review: The Trademark Office verifies the application details.
  4. Publication in Trademark Journal: Once accepted, the renewal is published in the Trademark Journal.
  5. Opposition Period: Third parties may oppose the renewal within four months of publication.
  6. Issuance of Renewal Certificate: If no opposition arises or it is resolved in the owner’s favor, a renewal certificate is issued.
  7. Fee Payment: Complete the process by paying the renewal fee online or at the Trademark Office.
